A complaint was filed in the Central District of California by plaintiff Orange County Coastkeeper against Alloy Die Casting Co.
ADC has been the owner and/or operator of a facility that provides die castings made of aluminum and zinc/aluminum alloys since at least Mar. 28, 2017.
According to the complaint, because of the defendant’s industrial operation, unlawful pollutants were discharged into the city of Buena Park’s municipal storm sewer system. This is in violation of the Clean Water Act and California’s Storm Water Permit, according to the complaint, which is for declaratory and injunctive relief and civil penalties.
The complaint alleges that the pollution began on Mar. 28, 2017 and is ongoing.
Buena Park’s municipal storm sewer system flows into the Pacific Ocean, Fullerton Creek, Coyote Creek, and San Gabriel River, according to the complaint.
The complaint adds that: "Defendant’s failure to comply with the procedural and substantive requirements of the Storm Water Permit and/or the Clean Water Act including, but not limited to, discharges of polluted storm water from the Facility, failure to report such pollution, and failure to act in accordance with the Storm Water Permit to improve the quality of storm water discharges from the Facility, degrades water quality and harms aquatic life in the San Gabriel River and its tributaries, and impairs Orange County Coastkeeper members’ use and enjoyment of those waters, giving Plaintiff standing on behalf of its members."
There are three separate violations of the Clean Water Act and seven individual violations of California’s Storm Water Permit noted, reported Law Street Media.
